These terms of service govern your use of the commonqipj spa membership and loyalty platform. By accessing or using our services, you agree to be bound by these terms.
By accessing, browsing, or using the commonqipj platform, website, mobile application, or any related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our services.
These terms constitute a legally binding agreement between you and commonqipj B.V., a company incorporated under Dutch law with registration number A11021253 and VAT number NL448565825B01, having its registered office at Berkenlaan 248, 5019 SV Tilburg, North Brabant, Netherlands.
commonqipj operates a spa membership and loyalty platform that connects members with premium spa and wellness services across the Netherlands. Our services include membership management, spa booking facilitation, loyalty rewards programme, and customer support services.
We act as an intermediary between members and spa partners. While we facilitate bookings and manage memberships, the actual spa services are provided by our partner establishments, each of which operates independently.
To use our services, you must create an account and maintain an active membership. You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You must notify us immediately of any unauthorized use of your account.
Membership fees are charged according to your selected membership tier and billing cycle. All fees are non-refundable unless otherwise specified in your membership agreement or required by law.
You agree to use our services only for lawful purposes and in accordance with these terms. You must not use our platform to engage in any fraudulent, abusive, or illegal activities. You are responsible for your conduct and any content you submit through our platform.
You agree to respect the policies and procedures of our spa partners when using their facilities. You must arrive on time for appointments and provide appropriate notice for cancellations as required by the individual spa's policies.
You must not attempt to circumvent our platform to book directly with spa partners or to avoid membership fees. Such actions may result in immediate termination of your membership.
Bookings are subject to availability and the individual policies of our spa partners. We facilitate the booking process but do not guarantee availability of specific treatments or time slots. Each spa partner may have different cancellation and rescheduling policies.
You are responsible for understanding and complying with the specific policies of each spa you visit. Failure to comply with cancellation policies may result in charges or loss of loyalty points.
Membership fees are charged in advance according to your billing cycle. You authorize us to charge your designated payment method for all applicable fees. If payment fails, we may suspend or terminate your membership after appropriate notice.
Additional charges may apply for premium services, upgrades, or treatments not included in your membership tier. All prices are in Euros and include applicable VAT unless otherwise stated.
All content, features, and functionality of the commonqipj platform, including but not limited to text, graphics, logos, images, software, and design, are owned by commonqipj or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our platform for personal, non-commercial purposes in accordance with these terms. You may not reproduce, distribute, modify, or create derivative works of our content without written permission.
The commonqipj name, logo, and related marks are trademarks of commonqipj B.V. You may not use these trademarks without our prior written consent.
commonqipj provides its platform and services "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, commonqipj shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities.
Our total liability to you for any claim arising from or relating to these terms or our services shall not exceed the amount you paid to commonqipj in the twelve months preceding the claim.
We are not responsible for the quality, safety, or legality of spa services provided by our partners. Any issues with spa services should be addressed directly with the relevant spa establishment.
You agree to indemnify, defend, and hold harmless commonqipj, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
You may terminate your membership at any time by contacting our customer support team. Termination will be effective at the end of your current billing cycle unless you have violated these terms, in which case termination may be immediate.
We may suspend or terminate your membership immediately if you breach these terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use our services will cease immediately.
Termination does not relieve you of any obligations incurred prior to termination. Provisions of these terms that by their nature should survive termination will remain in effect after termination.
We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on our website and, where appropriate, by email. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
If you do not agree to the modified terms, you must discontinue use of our services and may terminate your membership in accordance with our termination procedures.
These terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the competent courts in Tilburg, Netherlands.
If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these terms affects your statutory rights as a consumer.
We encourage you to contact us first to resolve any disputes informally. If a dispute cannot be resolved through informal negotiations, we are committed to resolving disputes through binding arbitration or small claims court rather than courts of general jurisdiction.
If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.
